Judge denies New York AG’s attempt to hold pro-life advocates in contempt

CV NEWS FEED // Pro-life organization Red Rose Rescue did not violate a court-ordered buffer zone around the Manhattan Planned Parenthood, a judge decided March 10.

The Thomas More Society, which represented the advocates, announced in a press release that U.S. District Court Judge Kenneth M. Karas, following oral arguments and a number of hearings, ruled that the Red Rose Rescue group was not in contempt of court.  

New York Attorney General Letitia James had filed a contempt motion in August 2024 against Red Rose Rescue, arguing that a protestor allegedly affiliated with the group violated a previous court order related to the Freedom of Access to Clinic Entrances (FACE) Act. 

A December 2023 court order prevented Red Rose Rescue from coming within 15 feet of any abortion clinic with the intent of violating the FACE Act through force, threat of force, or physical obstruction. The court order did not prohibit peaceful protests or other activities guaranteed by the First Amendment.

In the August court motion, James claimed that the pro-life advocate allegedly affiliated with Red Rose Rescue had “accosted” patients outside of a Manhattan Planned Parenthood. 

Body cam footage and other evidence proved that the protester had not violated the court-ordered buffer zone, the release said, adding that the protestor had not engaged in the use of force, threat of force, or physical obstruction. 

“We are very pleased with the Court’s thorough and well-reasoned opinion, denying Letitia James’ attempt to further silence our pro-life clients,” Thomas More Society Senior Counsel Christopher Ferrara stated. “The evidence we provided in defense of Red Rose Rescue clearly demonstrated [that] there was no violation of the injunction, including the bodycam footage showing that every claim of misconduct made by the AG’s two partisan witnesses was demonstrably false.”
