A Virginia school district has placed three male students under a Title IX investigation after a female student entered their locker room and recorded them having a private conversation about their discomfort sharing their locker room with her.
United States Parents Involved in Education (USPIE), a parental rights coalition, issued a press release May 27 regarding the alleged events at the school within Loudoun County Public Schools (LCPS), a district that has come under fire multiple times for its handling of sex-segregated spaces.
“After the girl allegedly took a covert video of the boys discussing the situation, LCPS started the investigation of the boys, not the girl,” the release reads.
USPIE Founder and President Sheri Few added, “Children should not be subject to the Left’s indoctrination in their schools, and these boys should not be punished for feeling uncomfortable in a locker room that is meant for boys, not girls — and vice versa.”
According to a May 15 article published by The Federalist, Trump’s Department of Education began investigating the LCPS district in February to determine whether it violated Title IX by allowing males in female bathrooms and locker rooms.
The Federalist reported that a female student, who says she is a male, started using the male locker room in the beginning of the 2024-25 school year. Renae Smith, the mother of one of the male students, said that her son spoke to the school staff about the policy.
“We are a Christian family,” Smith said. “We have Christian beliefs and Christian morals. We believe that there are two genders, and therefore, my son has a boundary around sharing a private room or a locker room with a biological female.”
Smith said that authorities, including the gym teacher, shot down her son’s repeated attempts to bring up the situation. In March, however, LCPS called her after they received the video from the female student. Smith described the phone call as a “nonchalant” conversation and she reiterated that her son had tried to express his discomfort with the situation earlier in the year.
Shortly afterward, though, the school district took a more hostile attitude toward Smith, her son, and the other boys in the video.
The Federalist states that LCPS’ policies specifically prohibit filming in areas where minors frequently change or shower, but the school district would not answer whether or not they were investigating the female student for filming the male students.
ABC 7News obtained and posted the footage, which does not depict anyone undressed.
The boys make a few comments about the female student, with one asking, “Why is there a girl? I’m so uncomfortable there is a girl.”
Another boy responded, “A female, bro, get out of here.”
Smith told the Federalist that after the incident, she received a call informing her of a formal Title IX investigation, due to alleged comments that her son and the other boys made in the locker room. She also mentioned receiving a letter.
According to ABC 7News, the school district refused to give the parents the footage of the boys under investigation. The parents had to submit a Freedom of Information Act request to the Loudoun County Sheriff’s Office (LCSO), which was reviewing the video to see if the female student committed a crime by recording minors in a locker room.
Seth Wolfe, the father of one of the boys, did eventually see the video at his son’s Title IX meeting with the school authorities, ABC 7News added. However, this was only after the authorities asked the son many questions in what Wolfe thinks was an attempt to have him admit to something he did not do.
“They didn’t show us the video until after they had tried to get my son to say who said what and all this kind of stuff,” said Wolfe, adding that the Title IX complaint did not include the boys’ quotes from the video. “But then once we saw the video, then we started asking about those context questions and how that can be left out. And they didn’t really have a good answer for that.”
The district’s approach to sex-segregated spaces has drawn sharp scrutiny in the past. USPIE wrote in its release that LCPS allegedly covered up a rape that occurred in 2021 when a male student wearing a skirt entered the girls’ bathroom. The male was transferred to another high school, where he assaulted another female student.
“This is the same Virginia district that covered up a rape and an assault in 2021 and has silenced parents at school board meetings,” Few stated in the release. “The only sure way to protect kids is to get them out. Even after Loudoun’s board became the national symbol of public-school tyranny, they have not backed off even a little.”
Smith spoke about how the investigation has put stress on her and the other families involved.
“The emotional weight of having my son mischaracterized for something that was never meant to hurt anyone is really heavy,” Smith said in a phone interview with The Federalist. “He didn’t act out of hate. He spoke from a place of honesty and vulnerability and confusion, as most people have in situations like this. And, yet, he’s been treated as if he did something malicious.”
The father of the third boy, who remained anonymous, told The Federalist that the family is considering moving away from the county. His son also wanted to drop out of school, and the father assured him that he did nothing wrong.
ABC 7News reports that only one LCPS board member responded to the outlet’s requests for comments.
“What we are seeing and will continue to see, are the consequences of policies that have introduced confusion and conflict into spaces that were once clear and safe—especially for young children,” Deana Griffiths told the outlet. “The truth is, many of these issues would never have arisen if we had upheld the basic principle that boys and girls are biologically different. LCPS students deserve their own private, secure spaces, particularly in bathrooms and locker rooms. Recognizing biological differences isn’t discriminatory; it’s common sense, and it’s essential for protecting the dignity and safety of all children.”
